Business identity

FitMom Wellness is owned and operated by Melburn Brown in Kansas. Questions about these terms may be sent to support@fitmomwellness.com or submitted through the Contact page.

Eligibility and account responsibility

FitMom membership is available only to adults age 18 or older. By creating an account or starting a trial, you confirm that you are at least 18 and legally able to enter this agreement. You are responsible for maintaining access to the email account used to sign in and for activity under your FitMom account.

Membership

FitMom provides digital fitness, meal-planning, tracking, challenge, mindset, and community features.

Trial, recurring billing, and consent

The membership includes a seven-day free trial. Unless canceled before the trial ends, the selected payment method is charged $47 and then charged $47 every month until canceled. Taxes may apply where required. Immediately before checkout, FitMom displays the trial length, renewal price, monthly billing frequency, cancellation method, cancellation timing, and refund terms. You must affirmatively agree to those terms before FitMom creates a Stripe checkout session, and FitMom records that consent.

Health and safety

FitMom is general educational wellness content, not medical diagnosis, treatment, physical therapy, nutrition therapy, or emergency care. Consult a qualified healthcare professional before beginning when pregnant, postpartum, injured, managing a health condition, taking medication that affects exercise or nutrition, or unsure whether an activity is appropriate. Stop for pain, dizziness, chest pain, unusual shortness of breath, increased bleeding, pelvic pressure, leaking, or other concerning symptoms.

No guaranteed result

Results vary with health, consistency, nutrition, sleep, stress, and other factors. FitMom does not guarantee weight loss, body-fat reduction, or any particular result.

Community rules

Be respectful and supportive. Do not post harassment, hate, spam, dangerous instructions, unlawful content, private information about another person, or content that impersonates someone else. FitMom may remove content or restrict access to protect members and the service.

Acceptable use

FitMom content is for the member’s personal, noncommercial use. Do not copy, resell, scrape, disrupt, reverse engineer, or misuse the service.

Account suspension and termination

FitMom may suspend or terminate access for nonpayment, material violations of these terms, unlawful or harmful conduct, threats to members or service security, or misuse of the service. When reasonably possible, FitMom will provide notice and an opportunity to correct the issue. Immediate action may be taken when needed to protect members, FitMom, or others.

Service changes

FitMom may update, add, or discontinue features and content. FitMom will provide reasonable notice when a material change substantially reduces a paid membership benefit. The service may occasionally be unavailable for maintenance, security work, or circumstances outside reasonable control.

Intellectual property

FitMom and its licensors own the service, branding, software, designs, workouts, recipes, and other FitMom content, subject to applicable third-party rights. Your membership grants a limited, revocable, nonexclusive, nontransferable right to use the service for personal, noncommercial purposes. You retain ownership of content you submit and grant FitMom a limited license to host, display, and process it only as needed to operate and moderate the service.

Warranty disclaimer

FitMom provides the service on an “as available” basis. To the fullest extent permitted by law, FitMom disclaims implied warranties of merchantability, fitness for a particular purpose, and noninfringement. FitMom does not disclaim warranties or consumer protections that cannot legally be excluded.

Limitation of liability

To the fullest extent permitted by law, FitMom and its owner will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, or goodwill arising from the service. To the fullest extent permitted by law, total liability for claims arising from the service will not exceed the amount you paid FitMom during the 12 months before the event giving rise to the claim. These limits do not apply where applicable law does not allow them and do not limit liability for gross negligence, willful misconduct, personal injury caused by legally actionable conduct, privacy violations, or statutory rights that cannot be waived.

Indemnification

To the extent permitted by law, you agree to reimburse FitMom for reasonable losses, liabilities, and expenses arising from your unlawful misuse of the service, violation of these terms, or infringement of another person’s rights. This provision does not require you to indemnify FitMom for FitMom’s own unlawful conduct.

Dispute process

Before filing a claim, contact support@fitmomwellness.com and allow 30 days for a good-faith informal resolution. If the dispute is not resolved, either party may bring an eligible claim in small-claims court or another court with jurisdiction in Kansas. Nothing in these terms prevents either party from seeking urgent injunctive relief or using rights that cannot legally be waived.

Changes to these terms

FitMom may revise these terms as the service changes. The updated terms will show a new effective date. For material changes, FitMom will provide advance notice by email, an in-app notice, or both when reasonably possible. Changes apply prospectively from their stated effective date. Continued use after that date constitutes acceptance where permitted by law. FitMom will obtain renewed affirmative consent when a change materially affects recurring billing or consumer-health-data processing and applicable law requires it.

Governing law

These terms are governed by the laws of the State of Kansas, without regard to conflict-of-law principles.
